Affiliate Program Terms of Service for ShoesHave.com
Agreement
By signing up to participate in the ShoesHave.com Affiliate Program ("Program"), you agree to comply with the following terms and conditions ("Terms of Service"). ShoesHave.com reserves the right to update and modify the Terms of Service from time to time without prior notice. Any new features or tools added to enhance the Program will be subject to these Terms. Continued use of the Program after any changes signifies your acceptance of those changes.
Violation of any terms outlined below may result in the termination of your account and forfeiture of any outstanding commissions. You agree to use the Affiliate Program at your own risk.
Account Terms
- You must be 18 years or older to participate in the Program.
- You must provide a valid email address and full legal name during the signup process.
- You are responsible for maintaining the security of your account and password. ShoesHave.com will not be liable for any loss or damage due to failure to meet this security obligation.
- You are solely responsible for all content and activity under your account.
- Multiple accounts per individual or legal entity are not allowed.
- You may not use the Program for illegal or unauthorized purposes, including but not limited to violations of copyright or other laws.
Links/Graphics on Your Site, Emails, or Communications
Once you are enrolled in the Program, you will be given a unique Affiliate Code. You are allowed to place provided links, banners, or other promotional graphics on your site, in your emails, or through other communications. ShoesHave.com will supply you with guidelines, link styles, and artwork to help you effectively promote our products. We may modify the artwork design at any time but will provide proper notice before changing image dimensions.
To ensure accurate tracking, reporting, and referral fee accrual, you must use the provided special link formats. Only sales completed through Special Links will qualify for referral fees. We are not responsible for any commissions lost due to incorrect use of the Affiliate Code or failure to use Special Links.
Referral Fees, Commissions, and Payment
To qualify for a referral fee, the customer must click on a Special Link from your site, email, or other communication and complete the purchase during that session.
Commissions are paid only for sales tracked by our system. If a purchase is made outside of tracked links, no commission will be provided. We reserve the right to disqualify commissions from fraudulent or questionable sales practices.
Payments begin when your earned commissions exceed $20. If you do not reach this threshold, no payments will be made until the amount surpasses $20.
Product Responsibility, Quality Assurance, and Testing
ShoesHave.com is committed to the highest standards of product quality. Before any product is made available for sale, it undergoes a thorough testing and inspection process to ensure durability, functionality, and safety. In the rare event that a product is defective, ShoesHave.com takes full responsibility and will resolve any issues promptly. Affiliates can confidently promote our products, knowing that we prioritize customer satisfaction and stand by the quality of our offerings.
Identifying Yourself as a ShoesHave.com Affiliate
You may not issue any press releases related to this Agreement or your participation in the Program. Misrepresenting your relationship with ShoesHave.com, such as claiming to develop our products or implying our endorsement of any external cause, is prohibited.
Purchases made through your affiliate links for personal use will not be eligible for commissions. Such purchases may result in commission withholding or account termination.
Payment Schedule
As long as your affiliate earnings exceed $20, you will receive monthly payments. If your earnings do not meet the $20 threshold by the end of the month, payment will be made the following month once you have exceeded the threshold.
Customer Definition
Customers who purchase products through the Program are considered our customers. Our policies regarding orders, customer service, and product sales will apply. Prices and availability may change, so affiliates are advised not to display product prices on their sites.
Your Responsibilities
You are responsible for the development, operation, and maintenance of your site and all materials posted. This includes ensuring that all links are displayed correctly and that your site does not violate any third-party agreements, intellectual property rights, or laws.
Compliance with Laws
As an affiliate, you must comply with all applicable laws, including the CAN-SPAM Act for email marketing and any local laws governing affiliate marketing activities.
Term and Termination of Agreement
This Agreement is effective upon our acceptance of your application and will remain in effect until terminated by either party. You or we can terminate the agreement at any time with written notice. Upon termination, you must remove all links to ShoesHave.com and cease using our trademarks or materials. Any outstanding commissions will be paid if they exceed $20.
Termination
ShoesHave.com reserves the right to suspend or terminate your account for any reason, including fraudulent or illegal sales activities. If your account is terminated, any unprocessed commissions will be forfeited.
Relationship of the Parties
You and ShoesHave.com are independent contractors. Nothing in this Agreement creates a partnership, joint venture, or agency relationship. You do not have the authority to make any representations on behalf of ShoesHave.com.
Limitations of Liability
ShoesHave.com will not be liable for indirect, special, or consequential damages, including loss of revenue or data, arising from this Agreement. Our total liability will not exceed the total referral fees paid to you under this Agreement.
Disclaimers
We do not make any express or implied warranties regarding the Program or products sold through it. We are not responsible for interruptions or errors in the operation of ShoesHave.com.
Independent Investigation
You acknowledge that you have read and understood this Agreement. You have independently evaluated the desirability of participating in the Program and are not relying on any representations other than those set forth in this Agreement.
Arbitration
Any disputes related to this Agreement shall be settled through confidential arbitration under the rules of the American Arbitration Association. In cases involving violations of intellectual property rights, we may seek appropriate relief in state or federal court.
Miscellaneous
This Agreement is governed by the laws of the United States. You may not assign this Agreement without our written consent. This Agreement constitutes the entire agreement between you and ShoesHave.com.
